{"id":622,"date":"2014-04-21T02:13:18","date_gmt":"2014-04-21T02:13:18","guid":{"rendered":"http:\/\/payne.org\/blog\/?p=622"},"modified":"2021-03-28T19:44:33","modified_gmt":"2021-03-28T19:44:33","slug":"the-disrupted-fight-back-with-lobbyists","status":"publish","type":"post","link":"https:\/\/payne.org\/blog\/the-disrupted-fight-back-with-lobbyists\/","title":{"rendered":"The Disrupted Fight Back With Lobbyists"},"content":{"rendered":"<p>Is it just me, or does it seem like an increasing number of successful technology startups are running into growing&nbsp;legal and regulatory issues? &nbsp;Specifically, the incumbents&nbsp;getting disrupted&nbsp;aren&#8217;t always fighting back in the market; they&#8217;re fighting back with lobbyists.<\/p>\n<p>Consider these current examples:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Aereo.<\/strong>&nbsp; This company receives&nbsp;free over-the-air signals (using&nbsp;mini antennas, one per subscriber) and streams them on-line. &nbsp;The networks aren&#8217;t happy because they&#8217;re not getting paid the way cable companies have to pay. &nbsp;This case is pending at the Supreme Court, and the <a href=\"http:\/\/www.cnbc.com\/id\/101597190\">press is comparing it to the 1984 Betamax ruling<\/a> that made it legal to record TV shows at home.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Uber.<\/strong>&nbsp;There are so&nbsp;many lawsuits from taxi companies and associations, I don&#8217;t even know where to start.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Airbnb.<\/strong> &nbsp;Cities want the hospitality tax (Airbnb is moving to collect taxes in New York, San Francisco, and Portland) and the hospitality industry doesn&#8217;t want the competition.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Tesla.<\/strong> &nbsp;Can you name any other industry where a manufacturer can&#8217;t sell their own product? &nbsp;Laws designed to protect auto dealerships from anti-competitive moves by their <em>current<\/em> manufacturers&nbsp;are now being used by dealers to prevent <em>new<\/em> manufacturers.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Google Fiber.<\/strong>&nbsp; The ISP lobby has gotten&nbsp;limits on municipal&nbsp;broadband in 20 states, and a fairly extreme (restrictive) bill was proposed in Kansas (but doesn&#8217;t <a href=\"http:\/\/arstechnica.com\/business\/2014\/02\/its-dead-kansas-municipal-internet-ban-was-stabbed-shot-and-hanged\/\">seem to be going anywhere<\/a>). &nbsp;ISPs&nbsp;don&#8217;t think it&#8217;s fair to compete with municipalities who take matters into their own hands to get competitive broadband service.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Every Bitcoin startup.<\/strong> &nbsp;This one is so early in the <a href=\"https:\/\/kryptoszene.de\/bitcoin-robot\/bitcoin-era\/\">Bitcoin era<\/a>, most folks don&#8217;t even know where to start lobbying. &nbsp;That didn&#8217;t stop my home state senator, Joe Manchin to <a href=\"http:\/\/www.washingtonpost.com\/blogs\/the-switch\/wp\/2014\/02\/26\/sen-joe-manchin-calls-for-a-bitcoin-ban-as-regulators-seek-accelerated-push\/\">call for a complete ban<\/a>. It was embarrassing (he&#8217;s since backed off, a little).<\/p>\n<p>What&#8217;s most interesting: &nbsp;in every single case (except Bitcoin, too early), the consumers are very happy (often <em>extremely<\/em> so). &nbsp;They&#8217;re enjoying the fruits of innovation and competition &#8212; <span style=\"text-decoration: underline;\">exactly<\/span> the way things are supposed to work.<\/p>\n<p>By virtually any test of our fundamental policies regarding free markets, anti-competitive practices, and restraint of trade, these innovators should not have so much regulatory&nbsp;headwind!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Is it just me, or does it seem like an increasing number of successful technology startups are running into growing&nbsp;legal and regulatory issues? &nbsp;Specifically, the incumbents&nbsp;getting disrupted&nbsp;aren&#8217;t always fighting back in the market; they&#8217;re fighting back with lobbyists.
